Senator Rick Scott introduces S. 5682: Foreign Government-Owned Media FARA Registration Act
Investivoq LegislationRadar
We have received text from S. 5682: Foreign Government-Owned Media FARA Registration Act. This bill was received on 2026-10-15, and currently has no cosponsors.
Here is a short summary of the bill:
This bill would change the Foreign Agents Registration Act so that certain foreign government-owned media outlets operating in the United States would be treated as “agents of a foreign principal” and therefore required to register under FARA, unless they meet specific independence exceptions.
What would count as a covered media outlet
The bill would include any news or press service or association operating in the United States that is owned, controlled, or financed, directly or indirectly, in whole or in part, by a foreign government. Such an outlet would generally have to register as a foreign agent unless it can show both of the following:
- It has the legal freedom, under the foreign country’s laws, to take positions against the foreign government that owns or finances it.
- It can convince the Attorney General that it is independent in all editorial decisions.
Which outlets would not be covered
The bill would keep the existing exclusion for certain U.S.-organized news outlets, including newspapers, magazines, periodicals, digital media, and other publications published in the United States that meet the current legal conditions. In general, those outlets would not be covered solely because they do normal journalistic activities like selling ads or subscriptions, so long as they are at least 80% beneficially owned by appropriate owners and are not controlled or financed by a foreign principal or registered foreign agent.
Reporting to Congress
The bill would also change the reporting requirements for the Attorney General. Each year, the Attorney General would have to submit a report to Congress that includes:
- information on registrations filed under FARA;
- the nature, sources, and content of political propaganda disseminated and distributed; and
- a list of each foreign media outlet operating in the United States that is owned, controlled, or financed by a foreign government.
For each such outlet, the report would also have to say whether it is registered under FARA, and if not, explain why not.
Practical effect
In plain terms, the bill is meant to make foreign government-backed media operating in the U.S. more likely to be treated as foreign agents under federal law, which would increase disclosure and reporting requirements. It would also require the Justice Department to identify those outlets in annual reports to Congress.
