This bill would change how the Department of Housing and Urban Development (HUD) can accept proof that certain projects meet federal domestic-content rules under the Build America, Buy America Act.

What it would do

For HUD-administered federal financial assistance, the bill says the Secretary of Housing and Urban Development must treat documentation created under the Make It American Process Standard (NEMA 70901–2024), or a later version approved by the Secretary, as sufficient evidence that a recipient’s domestic-content certification meets the legal requirements.

What it would not do

  • It would not require recipients of HUD funding to use that standard.
  • It would not prevent recipients from using other legally allowed methods to show compliance with domestic-content requirements.

Other flexibility

The bill would also allow the Secretary, if considered appropriate, to accept documentation produced under other standards that are similar to the Make It American Process Standard, as long as the process is auditable and verifiable.

Practical effect

In plain terms, the bill would give HUD a clearer basis for accepting certain documentation as proof that materials or products meet domestic-content rules. It would standardize one type of paperwork for compliance purposes, while still allowing other lawful ways to demonstrate compliance.
