Representative Nancy Mace introduces H.R. 10801: School Freedom Act of 2026

Investivoq LegislationRadar

We have received text from H.R. 10801: School Freedom Act of 2026. This bill was received on 2026-10-13, and currently has no cosponsors.

Here is a short summary of the bill:

This bill would end most existing federal K-12 education programs by June 30, 2027 and replace that funding with tax-advantaged School Freedom Accounts for families. Parents would be able to use the accounts to pay for approved education expenses for their children, rather than having the money go directly to federal K-12 programs.

School Freedom Accounts

The bill creates a new account system for eligible students. These accounts would be available for U.S. citizens or nationals who:

  • have not yet finished secondary school,
  • are eligible to attend K-12 school, and
  • have a parent who is a U.S. citizen or national.

The accounts would be tax-advantaged, meaning they would receive favorable tax treatment under the bill’s rules. Parents would be allowed to use the money for approved education-related costs for their children.

Use of Remaining Balances

If money remains in a School Freedom Account after K-12 education, the bill would convert the unused balance into accounts for higher education and job skills training. Those later accounts would be used for postsecondary education or training expenses.

Definitions

For the most part, the bill uses existing federal education definitions for terms related to education programs and eligibility. Higher education would be defined using the Higher Education Act.
